App Privacy Policy

This policy explains how 40/40 Club, LLC ("40/40 Club," "we," "us") collects, uses and shares information when you use the 40/40 Club iPhone app (the "App") and our website at 4040.club (together, the "Services"). Our store's general privacy policy is at 4040.club/policies/privacy-policy. The Services are intended only for adults 21 and older.

1. Information we collect

Account information. When you sign in with Shop or create an account, we receive your name, email address and customer ID from Shopify, our store platform.

Orders and purchases. Shopify processes your orders, shipping and payment details. We can see your order history, but we never receive your full card number. If you buy the Remove Ads subscription in the App, Apple handles the payment. We only learn whether your subscription is active.

Your collection. The bourbon, watch and sneaker items you add, including photos, notes, values and logs, are stored on your device and in your own iCloud account. We don't have access to that data.

Friends features (optional). If you create a friends profile, we store your username, display name, bio and privacy settings. Depending on your settings, we also store the collection items and activity you choose to share. You decide what friends can see in Account › Privacy & sharing.

Scan. When you use Scan, the photo you take is sent to our server and to an AI service to identify the item and estimate its value. We don't keep the photo after the result is returned.

Advertising and device data. The free version of the App shows banner ads provided by Unity Ads. Unity and its partners may collect your device's advertising identifier (only if you allow tracking when the App asks), approximate location based on your IP address, ad interactions, app usage data, performance and diagnostic data, and similar information. Website data. Our website, which runs on Shopify, uses cookies and similar technologies for the cart, checkout, analytics and site security.

2. How we use information

We use information to:

  • provide and improve the Services
  • process orders and subscriptions
  • run the friends features
  • identify items you scan
  • show ads to users who haven't removed them
  • provide customer support
  • prevent fraud and abuse
  • meet our legal obligations

3. How we share information

We don't sell your personal information for money. We share information only with:

  • Shopify, which runs our store, accounts and checkout
  • Apple, for iCloud sync and in-app purchases
  • Cloudflare, which hosts the App's friends and Scan services
  • Unity Ads, which provides advertising
  • Authorities, when the law requires it
  • A buyer or successor, if our business is sold or merged

Ad partners may use device data for targeted advertising. Under some U.S. state laws, that can count as "selling" or "sharing" personal information; see your choices below.

4. Your choices

  • Tracking: you can allow or deny tracking when the App asks. You can change it any time in iPhone Settings › Privacy & Security › Tracking.
  • Ads: subscribe to Remove Ads (Account › Remove ads) to turn off all ads in the App.
  • Friends privacy: control what you share in Account › Privacy & sharing, or delete your friends profile.
  • Delete your account: in the App, go to Account › Delete my account. Or contact us and we'll delete your account and associated data, except records we must keep by law, such as order records.
  • Marketing emails: use the unsubscribe link in any email.

5. Your rights

Depending on where you live, including California and other U.S. states, you may have the right to:

  • know what personal information we have about you
  • get a copy of it
  • correct or delete it
  • opt out of targeted advertising or the "sale" or "sharing" of your information

To make a request, contact us using the details below. We won't treat you differently for using these rights.

6. Data retention

We keep account and friends data while your account is active, and delete it when you delete your account. We keep order records as long as tax and legal rules require. Scan photos are not kept.

7. Age requirement

The Services are for people 21 and older. We don't knowingly collect information from anyone under 21. If you believe a minor has provided us information, contact us and we'll delete it.

8. Security

We use reasonable safeguards, including encrypted connections and secure sign-in, to protect your information. No method of transmission or storage is 100% secure.

9. Changes

We may update this policy. We'll change the "Last updated" date and, for significant changes, let you know in the App or by email.
